Distance Sales Agreement

1 Parties
1.1 Seller Information

1.2 Buyer Information

The real or legal person who shops, becomes a member, or places an order through the website; declared in the invoice and delivery information (hereinafter referred to as “Buyer”). The contact and address information used by the Buyer when placing the order shall be taken as a basis.
2 Subject of the Agreement
The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product, whose qualities and sales price are specified on the website, which the Buyer has ordered electronically through the Seller's website.
3 Product Subject to the Agreement, Payment, and Delivery Information
• Product Information: The type, kind, quantity, brand/model, color, and sales price including all taxes of the products subject to the contract are as they appear on the website at the time the order is completed and as stated in the Shopify system approval email sent to the Buyer.
• Payment Method: The Buyer can make the payment for the order via credit card, debit card, or other available methods through the Shopify integrated secure payment infrastructures offered on the website. Deferred or installment transactions are at the discretion of the card-issuing bank.

• Delivery and Shipping: The Seller is obliged to send the ordered products to the delivery address specified by the Buyer during the order, through the contracted cargo company, provided that it does not exceed the legal period of 30 days. Shipping costs and any additional expenses, unless otherwise stated on the website, belong to the Buyer.
4 General Provisions
• The Buyer accepts that they have read the Preliminary Information Form regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the contract on the website and have acquired information and given the necessary confirmation electronically.
• The Seller is responsible for delivering the product subject to the contract intact, complete, in accordance with the specifications stated in the order, and with any warranty certificates and user manuals, if any.
• For the delivery of the product subject to the contract, it is essential that this contract has been approved electronically and that the total amount has been transferred to the Seller's account through Shopify's secure payment channels. If for any reason the product price is not paid or canceled by the bank, the Seller is deemed to be released from the obligation to deliver the product.

• If, after the delivery of the product, the credit card belonging to the Buyer is used unfairly or unlawfully by unauthorized persons for reasons not arising from the Buyer's fault, and the relevant bank or financial institution does not pay the product price to the Seller, the Buyer must return the delivered product to the Seller within 3 days. In this case, the shipping costs belong to the Buyer.
5 Right of Withdrawal and Exceptions
5.1 Exercise of the Right of Withdrawal
The Buyer may return the goods by exercising the right of withdrawal within 14 (fourteen) days from the date of receiving the goods, without assuming any legal or penal responsibility and without stating any reason. To exercise the right of withdrawal, a clear notification must be made to the Seller's communication channels (via e-mail or written notification) within this period. The shipping cost of the product returned within the scope of the right of withdrawal is covered by the Seller, provided that the Seller's contracted cargo company is used.
5.2 Exceptions to the Right of Withdrawal
In accordance with Article 15 of the Distance Contracts Regulation, unless otherwise agreed by the parties, the consumer cannot exercise the right of withdrawal in the following contracts:
• Contracts for the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery, and whose return is not suitable for health and hygiene.
• Products prepared in line with the Buyer's requests or explicit personal needs, which are not suitable for return due to their nature.
• Contracts for the delivery of goods that are perishable or whose expiration date is likely to pass.
Important Note: In cosmetic, personal care, and hygiene product categories, the right of withdrawal can only be exercised if the product's packaging has not been opened, damaged, and the product has not been used.
6 Resolution of Disputes and Authorized Court
In disputes arising from this Agreement, the Consumer Arbitration Committees and Consumer Courts in the place where the Buyer purchased the goods or services or where their domicile is located are authorized, up to the value declared by the Ministry of Trade.

7 Effectiveness
The Buyer is deemed to have accepted all terms of this Agreement when placing an order through the website. The Seller is obliged to establish the technical integration that will allow the Buyer to read and approve this agreement in the Shopify payment step (checkout) before the order is placed.
